About Admiralty and Maritime Law
Admiralty law, also known as maritime law, is a specific section of the law which governs maritime offenses. It is not only United States law, but also could include private international laws as well. Maritime law deals with commercial activities that are land based, but involve maritime issues, such as shipping containers, as well as navigation, shipping, sailors and the transportation of goods and passengers at sea. Different from the Law of the Sea, a body of public international law dealing with navigational rights and other matters, it yet deals with a significant amount of international law including numerous multilateral treaties.
When there is a maritime legal issue that needs to be handled, the parties involved in the dispute cannot choose to disregard admiralty law. Neither can states infringe on admiralty jurisdiction in the courts or though legislature. As there can be aspects of a maritime issue that fall into the purview of a local jurisdiction, there is 28 USC § 1333(1), the “Savings to Suitors Clause,” which allows for concurrent state jurisdiction in certain matters.
The maritime laws follow the country of the flag being flown on the ship, regardless of which country’s waters it is in. A British ship flying the British flag in American waters would be subject to the admiralty laws for England, not the United States. This is true for any crime committed as well, and not just for maritime issues.
