Consensual sex between same-sex couples in unlawful [R1.3]

Penal Code, Decree No. 5/1962 (Effective April 3, 1964)

Article 409 Homosexuality

“Whoever –

(a) has carnal intercourse

(b) with a person of the same sex

shall be punished, where the act does not constitute a more serious crime, with imprisonment from three months to three years.

Where

a) the act committed

b) is an act of lust different from carnal intercourse, the punishment imposed shall be reduced by one-third.

In the southern parts Islamic courts rule, having imposed Islamic Sharia law punishing homosexual acts with death penalty or flogging.


On 10 January 2016, the Somali Islamist group al Shabaab reportedly shot two men and a teenager in the town of Buale in southern Somalia, saying one of the men and the 15-year-old had been seen having gay sex, while the other man was found guilty of spying [R1.2].

On 15 March 2013, gay teenager Mohamed Ali Baashi ,18, was allegedly buried in a hole up to his chest and stoned to death [R1.1].
