As at May 2010, consensual sex between same-sex couples is unlawful [R1.3].


Penal Code, Act 45/1860, Volume VIII, Revised Edition, provides –

Section 377

Whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animals shall be punished with transportation for life, or with imprisonment of either description for a term which may extend to 10 years, and shall be liable to fine [R1.2].

Penetration is sufficient to constitute the carnal intercourse necessary to the offence described in this section. [R1.2].


On 03 September 2015, it was reported that nine men were arrested in Mandalay for ‘acting inappropriately’. The men were ‘educated’ and then released on bond when it was found they had not committed any crimes [R1.1].

On 02 March 2014, in Yangon, Tin Ko Ko and Myo Min Htet reportedly married in a ceremony which stayed close to traditions and customs of other Burmese weddings. The ceremony does not carry any legal recognition [R1.1].
