On 01 October 2013, a lesbian couple from the Jhalakati District of Bangladesh were reported to be in jail because of their relationship – apparently charged under Section 290 of the Bangladesh Penal Code: “Whoever commits a public nuisance in any case not otherwise punishable by this Code, shall be punished with fine which may extend to two hundred taka” [R1.1].

On 11 November 2013, Prime Minister Sheikh Hasina announced that under the new Government policy, the rights of all hijras will be secured, enabling them to identify their gender in documents such as passports [R1.1].

2. Courts & Tribunals

In 2008, a Bangladeshi court ruled that transgender people are fully-fledged citizens and must have the right to vote [R2.1].

1. Legislation

The criminal law in Bangladesh prohibits consensual sex between same-sex couples [R1.1].

The Penal Code, 1860 (Act XLV of 1860) Section 377 “Unnatural Offences” provides –

“Whoever voluntary has carnal intercourse against the order of nature with man, woman, or animal, shall be punished with imprisonment of either description which may extend to life, or up to 10 years, and shall also be liable to fine.
Explanation: Penetration is sufficient to constitute the offence as described in this section.” [R1.1].
